WHAT IS DACA?

Deferred Action for Childhood Arrivals (DACA) allows individuals who meet certain guidelines to apply for an immigration benefit that will defer any prosecution by a U.S. immigration agency towards removal from the United States. The immigration benefit is temporary and not a pathway toward permanent lawful status. DACA recipients receive the benefit for 2 years with the opportunity to renew it. Those who receive approval may also apply for and receive authorization to work, a driver's license, and a Social Security card.

DACA generally benefits teenagers or young adults who either entered the U.S. without being inspected at a port of entry, or who entered with inspection but have overstayed the authorized period of time. Persons are eligible for DACA if they meet the following guidelines:

    - Arrived in the United States before the age of 16;

    - Were under the age of 31 as of June 15, 2012;

    - Have been physically present in the U.S. from June 15, 2007 until the current time;

    - Were physically present in the U.S. on June 15, 2012 and at the time of applying;

    - Are enrolled in school or GED classes or another form of education, or have graduated from High school or received a GED/High School equivalency diploma;

    - Do not have a felony, significant misdemeanor, or 3 minor misdemeanors;
